Bunbury man Gregory Humphries, 22, admits he started fatal brawl that resulted in retaliation to racist remark

One of the men accused of playing a key part in the death of a Bunbury father has admitted he incited the street brawl in an act of revenge that went too far. Evidence shown in court yesterday revealed Gregory Colin Humphries, 22, attacked Danny Talbot in May 2019 in retaliation to a violent incident earlier in the night inside Fitzgerald’s Irish Bar. Seen on CCTV during the trial, the one minute assault turned into a “free for all” where a friend of Mr Humphries took the chance to punch Mr Talbot to the ground, ultimately leaving him brain dead. The evidence comes during a ten day trial where Mr Humphries has pleaded not guilty to charges of assaulting another who died as a direct or indirect result and assault causing bodily harm at Busselton District Court. The interview was shown as part of the State’s case against Mr Humphries where they argue had he not been involved in the street brawl, Mr Talbot would not have fallen victim to the one punch attack. As revealed throughout the first week of trial, witnesses claim Mr Talbot had taken offence to Mr Humphries calling a friend “bro” in the bathroom and assaulted his soon-to-be-attacker and calling him a “black c**t”. The jury heard Mr Humphries tell police his version of events, telling police he wanted to know why the man, who was then unknown to him, attacked him however did not mean for the confrontation to “go so far”. “I’d say a bit of revenge, but I didn’t plan it out that way, it went a little too far,” he said. “I just wanted to see what his problem was…. I couldn’t really control myself, I’m different. “I’m sorry for what I’ve done, I didn’t mean for it to work out that way.” The admission, made the evening of the attack, is the first made throughout the trial. Mr Humphries’ is joined by Jonathon Lee Humphries, 20, and Kirk Angus Boyce, 27, at trial who have both pleaded not guilty to the same charges. Monday saw the completion of the State’s case against the three men, as the trial continues today and defence calls their first witness.
