Jetty contract may be terminated

Jetty refurbishment contractor Marine & Civil will have seven days to show cause why the Busselton hire Council should not terminate its contract.

The council held a special meeting on Wednesday afternoon to consider the future of the jetty contract since the marine experts went into voluntary administration earlier this month, affecting the refurbishment.

Community and organisational development director Matthew Smith told the Times the “show cause” action was a standard contractual procedure.

The council also gave delegation to CEO Mike Archer to assess Marine & Civil’s response and start any associated action, including the possible termination of the contract.

Marine & Civil will have seven days from when it received the show cause notice to respond to the Council.

Meanwhile, a creditor’s meeting was held in Perth last week which ratified the appointment of the administrator and appointed a committee of creditors.

WA Insolvency Solutions Administrator Chris Williamson said the meeting was “mostly procedural”.

Busselton Shire CEO Mike Archer told the Times previously that he had hoped the jetty project would be considered a stand-alone as there was funding by the State Government and the Shire.

Mr Williamson said a decision should be made in the next few days.

A second meeting with creditors was scheduled for December 15.

“The directors will be working towards a deed of company arrangement with creditors to enable the

company to stay open,” Mr Williamson said.
